These Terms of Use ("Terms") are an agreement between you and Workado, LLC ("BusinessLendingMatch", "we", "us") and govern your use of this website and our matching service. By using the site or submitting a request, you agree to these Terms and our Privacy Policy. Section 10 requires disputes to be resolved by individual arbitration and waives class actions.

1. Who can use the service

You must be at least 18, located in the United States and seeking a product or service for a business, and you must have authority to share the business information you submit.

2. What we do

BusinessLendingMatch is a free matching service. We use your answers to pick the lender in our network we believe best fits your request and pass your request to them. We are not a lender. We do not make offers, approvals or credit decisions, and we do not guarantee that you will be contacted, approved or offered any particular rate or terms. Any application, agreement or transaction is solely between you and that lender, on their terms, and they are responsible for their products, disclosures and conduct.

3. Fees

Using BusinessLendingMatch is free for you.

4. Your information and consent to be contacted

You agree that the information you submit is true, accurate and your own (or your business's), and that you will not submit anyone else's information. You authorize us to share your request with no more than 2 lenders in our network chosen as the best fit for your answers, and to give you their contact details. If you give consent on our form, you agree that we and those lenders may contact you at the phone number and email you provide, by call, text or email, including with automated technology and prerecorded or artificial voice messages, about your request, even if your number is on a do-not-call list. Consent is not a condition of any purchase. Message and data rates may apply. You may revoke consent at any time by any reasonable means, including replying STOP to a text or emailing us.

5. Not advice

Guides, calculators and other content on this site are general information only, not financial, legal, tax or accounting advice, and may not reflect current program rules or pricing. Talk to a qualified professional before making financial decisions.

6. Acceptable use

Do not submit false or fraudulent information, use the site for anyone else without authority, scrape or copy the site with automated tools, interfere with its security or operation, or use it for any unlawful purpose. We may refuse, remove or stop processing any request at our discretion.

7. Our content

The site and its content, design and trademarks belong to us or our licensors. You may view and print pages for your own use; any other use needs our written permission. Links to third-party sites are provided for convenience; we are not responsible for their content or practices.

8. Disclaimers and limits of liability

THE SITE AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT ALLOWED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, LOST PROFITS OR LOST FINANCING OPPORTUNITIES, OR FOR ANY ACT OR OMISSION OF ANY lender OR OTHER THIRD PARTY, AND OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO $100. Some jurisdictions do not allow some of these limits, so they may not fully apply to you.

9. Indemnity

You agree to indemnify and hold us harmless from claims, losses and costs (including reasonable attorneys' fees) arising from information you submit, your use of the site in violation of these Terms, or your dealings with any lender.

10. Disputes and arbitration

Please contact us first at hi@businesslendingmatch.com; most concerns can be resolved quickly. If we cannot resolve a dispute within 30 days, you and we agree that any dispute arising out of or relating to the site, the service or these Terms will be resolved by binding individual arbitration administered by the American Arbitration Association under its applicable rules, except that either party may bring an individual claim in small claims court. You and we waive any right to a jury trial and to bring or join a class, collective or representative action. You may opt out of this section by emailing us within 30 days of first accepting these Terms. If this section is found unenforceable, disputes will be resolved in the state or federal courts located in Arizona.

11. Electronic communications

You agree that we may provide notices, disclosures and records electronically, and that electronic agreements and consents have the same effect as signed paper ones.

12. General

These Terms are governed by the laws of Arizona and applicable federal law, without regard to conflict of law rules. We may update these Terms; the date at the top shows the latest version, and continued use means you accept the update. If any part is unenforceable, the rest remains in effect. These Terms and the Privacy Policy are the entire agreement between you and us about the site.
